Please read these Terms carefully. By accessing or using the Curasix platform, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a clinic or organisation, you represent that you have authority to bind that entity to these Terms.
These Terms of Service ("Terms") constitute a legally binding agreement between you (the "Subscriber" or "you") and Eviqex Sdn. Bhd. ("Curasix", "we", "us", or "our"), the operator of the Curasix clinic management platform.
By creating an account, accessing, or using any part of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not access or use our services.
Curasix is a cloud-based Software-as-a-Service (SaaS) platform designed for Malaysian healthcare providers. The platform includes, but is not limited to:

They do not constitute medical advice and are not a substitute for professional clinical judgement. Registered medical practitioners remain solely responsible for all clinical decisions and patient care.
To access the Curasix platform, you must register for an account by providing accurate, current, and complete information. You agree to keep this information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:
Curasix will not be liable for any loss or damage arising from your failure to maintain account security.
You may create accounts for your clinic's staff ("Authorised Users") within the limits of your subscription plan. You are responsible for ensuring all Authorised Users comply with these Terms.
Curasix is offered on a subscription basis. Current pricing plans are published at curasix.com/pricing. All prices are quoted in Malaysian Ringgit (MYR) and are exclusive of applicable taxes unless stated otherwise.
Subscriptions are billed monthly or annually, as selected at the time of purchase. Your subscription will automatically renew at the end of each billing cycle unless cancelled in accordance with Section 12.
Each plan includes a base allocation of 100 clinic encounters per month. Usage beyond this allocation is billed according to our tiered encounter pricing schedule, which is published on our pricing page and may be updated with 30 days' notice.
Payment is due in advance of each billing period. We accept payment via methods listed at checkout. You authorise us to charge the payment method on file for all amounts due. If payment fails, we may suspend access to the service after providing reasonable notice.
You are responsible for all applicable taxes, including Service Tax (SST) as levied by the Malaysian government. We will issue tax invoices in compliance with Malaysian requirements.
Subscription fees paid in advance are non-refundable except where required by applicable Malaysian consumer protection law. If we terminate your account without cause, we will provide a pro-rated refund for any prepaid unused subscription period.
You agree to use Curasix only for lawful purposes and in compliance with all applicable Malaysian laws and regulations, including but not limited to the:

We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions, including terminating access to the service.
All data that you or your clinic inputs into the Curasix platform ("Your Data") remains your property. You grant Curasix a limited, non-exclusive licence to store, process, and transmit Your Data solely for the purpose of providing the service to you.
You may export Your Data at any time via the export functions within the platform. Upon termination, we will make Your Data available for export for 90 days, after which it will be securely deleted from our systems.
Curasix may use anonymised and aggregated data derived from your use of the platform (which cannot be used to identify you or your patients) for the purposes of improving the service, industry benchmarking, and research.
For the processing of patient personal data, Curasix acts as a data processor and your clinic acts as the data controller under the PDPA 2010. Please refer to our Privacy Policy for full details.
The Curasix platform, including all software, designs, algorithms, trademarks, and documentation, is the exclusive intellectual property of Eviqex Sdn. Bhd. and is protected by Malaysian and international intellectual property laws.
These Terms do not transfer any intellectual property rights to you. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes during the term of your subscription.
You must not copy, modify, distribute, sell, or create derivative works based on the Curasix platform without our prior written consent.
We target a monthly uptime of 99.9% for the Curasix platform, excluding scheduled maintenance windows. In the event of downtime exceeding this target in a given calendar month, subscribers on Professional and Enterprise plans may request service credits in accordance with our SLA schedule.
We may perform scheduled maintenance that temporarily affects availability. We will provide at least 48 hours' advance notice for planned maintenance outside of business hours (Mon–Fri 9AM–6PM MYT), except in cases of emergency security patching.
The service is provided on an "as is" and "as available" basis. While we strive for high availability, we do not warrant that the service will be uninterrupted, error-free, or free from security vulnerabilities at all times.
Each party agrees to keep confidential the other party's non-public business information, technical data, and trade secrets. This obligation survives termination of these Terms for a period of three (3) years.
Confidentiality obligations do not apply to information that: (a) is or becomes publicly available without breach; (b) was known prior to disclosure; (c) is independently developed; or (d) is required to be disclosed by law or court order.
To the maximum extent permitted by Malaysian law:
Clinical Liability: Curasix is a clinic management and decision-support tool. All clinical decisions, diagnoses, and treatment plans are the sole responsibility of the registered healthcare professional using the system. Curasix assumes no liability for any adverse patient outcomes.
You agree to indemnify, defend, and hold harmless Curasix, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation takes effect at the end of the current billing period. No refund will be issued for the remainder of the current billing period.
We may suspend or terminate your account immediately, with notice where practicable, if:
Upon termination, your right to access the platform ceases immediately. We will retain Your Data for 90 days post-termination to allow data export, after which it will be securely and permanently deleted.
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.
Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be referred to the courts of Kuala Lumpur, Malaysia, which shall have exclusive jurisdiction.

Your continued use of the Curasix platform after the effective date of changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the service before the effective date.
